MODIFIED. Grievant, a Social Worker, was discharged for dishonesty, incompetence and neglect of duty when it was discovered that there were discrepencies in the handling of patients' funds. In addition, there were procedural issuesvregarding whether Grievant was confronted with the charges against him prior to his removal; whether Grievant was given an opportunity to tell his side of the story prior to removal; and whether the offer was in accordance with the LOUDERMILL Decision. Grievant's seniority and clear work record serve to mitigate teh penalty of discharge. The record evidence was insufficient to support removal.
