DENIED. In December of 1991, the Department of Mental Health laid off two employees in the Office of Psychiatric Services to Corrections. Both employees were employed at the unit at the Allen Correctional Institution. The Union brought the grievance alleging violations of Sections 1.04 and 18.01 of the Agreement. It claimed that management eroded the bargaining unit and violated the prohibition against assigning supervisory employees to perform bargaining unit work. The Union, however, was unable to show that the action was taken as a means of streamlining work for efficiency reasons or for the purpose of eroding the bargaining unit. The Union failed to demonstrate a bias or other assessment.
