AWARD: 0558 The grievant was issued a 35 day suspension comprised of events (oneì yielding a 5 day suspension, the second a 30 day). The 5 day suspension, forì domestic violence-conduct unbecoming an officer-had been held in abeyenceì while the grievant participated in the EAP. The patrol argued the secondì event-interfering with an officer on duty-another misconduct- annulled theì tenats of the EAP, and a 35 day suspension was progressive given the severityì of his misconduct. The arbitrator held the events were unrelated, and the 5ì day suspension was expressly for acts of domestic violence, which his laterì misconduct was not a case of. Thus the second suspension was found to beì unduly harsh and not progressive while the prior 5 day was technically stillì in abeyance. The grievance was modified;a 4 day suspension was imposed forì the later count of misconduct.
