AWARD: 0538 Grievant was removed from position for allegedly aiding an inmate escape. Theì Union argued that Management did not investigate thoroughly or objectively.ì Grievant was a ten year employee with only one prior discipline, for abusiveì language to his supervisor. He had no motive and the inmates' testimony wasì highly suspect. At no time were the inmates' testimony consistent, and inì both cases, their "cooperation" paid off. One inmate received no extra timeì for his attempted escape, and the other inmate was allowed to be paroled withì his indictment for escape dismissed. Management argued that just cause existed to discipline Grievant given thatì there was eyewitness testimony, a clear path of supporting circumstantialì evidence, and the fact that neither the Grievant nor his representative everì denied the charge.
