DENIED. The Grievance concerns Management's selection process involved in calling back troopers to report for extra duty activities. A less senior trooper was called back to work over Grievant. Candidate also lived further away than did Grievant. The Union contended that 5.03 requires overtime to be offered by seniority. Management maintained that the situation was controlled by Section 27.04, entitled Report Back Pay and does not contain a seniority clause. The very nature of "report back" for "unscheduled, unforeseen or emergency work" mandates employees return to work as quickly as possible. Article 5 has no relationship to a report back pay. Management stated that they called in those troopers who they thought were the closest. The Arbitrator held that there was no seniority requirement.
