GRANTED. Grievance concerned whether prisoner escapes should be considered an "emergency condition" entitling all relevant employees who were worked overtime are to be paid double time. The arbitrator found that the Lieutenant on duty repeated the word "emergency" innumerable times and Management is estopped to deny the declaration that the Lieutenant used the word incorrectly. Moreover, Management "ratified" the fact that it was an emergency. Everyone on second shift was held over violating routine overtime rules. Overtime rules can only be violated when an Article 13.15 emergency exists.
