GRANTED. Grievant, an Industrial Rehabilitation Consultant, was denied a promotion to Industrial Reemployment Specialist due to the position being offered to an employee, with the same position, with less seniority. The Union contended that that condidate was not "significantly more qualified based on the criteria set forth in the Agreement, and should not have been awarded the job. The Union argued that Grievant's experience is more relevant to the Reemployment Specialist's position than the selected candidate. Also, Grievant's education surpasses that of candidate. The Union felt that Management ignored the seniority issue. The Arbitrator agreed and ordered the Grievant promoted.
