DENIED. Grievant was suspended for six days for failing to report for his first shift overtime assignment. The Union argued that according to Article 13.07, Grievant should have been charged with double the amount of overtime accepted and a six day suspension is an additional penalty. Management maintained that they would never be able to enforce a contracted obligation if an employee was merely penalized in terms of overtime equalization opportunities. As such, overtime needs to be treated (in an institutional setting) as a regular shift assignment. The Arbitrator found that the penalty was commensurate with the offense.
