GRANTED. Grievant was given a 13-day suspension for fighting with a co-worker on duty. The arbitrator granted the grievance holding that the grievant was provoked into fighting. It was held, however, that the Employer did not violate the contract when it refused to provide the Union with results of an internal investigation, because it was shown that the investigation was not relied upon in the disciplinary process; its purpose being in anticipation of civil or criminal litigation.
