DENIED. Class grievance concerning telephone pay for Wildlife Officers with ODNR. The Union argued that if Management was of the view that Wildlife Officers had to have a listed telephone number on the yellow or blue pages, it should have told the Union during negotiations. Management is in violation of the contract for not paying seven of the nine officers. Management stated that the only restriction upon eligibility for the payment is the listing of the telephone. Should the Officer have a listing in the residential section it renders the general public unable to communicate with him/her. The Arbitrator found that Wildlife Officers are not in the class who are REQUIRED to maintain an office in their home if there is no telephone listing identifying the Officer in some fashion there is no "public listed phone" within the meaning of the Agreement. If an Officer choses not to receive calls on State business at his home, he/she forfeits eligibility for monthly payment.
