MODIFIED. This grievance concerned reductions in force at Oakwood Forensic Center. The reductions were the result of a steady decline in patient enrollments during the last 11 years. The Arbitrator held that the contract permits arbitration of the "substantive validity" of employer RIFS on a position-by-position basis with the burden being on the employer to demonstrate the validity of its decisions. Grievance denied with regard to layoff of three Education Specialists. Granted with regard to reduction of Librarians' hours to twenty-four per week.
