Grievance MODIFIED. The Arbitrator found that the Employer did not have just cause to remove Grievant, but did to discipline him. Grievant's attendance problems warranted a 10-day suspension, but not removal because the Employer was lax in enforcing its own attendance rules and call-in policies. However, due to Grievant's substance abuse problem, reinstatement was conditioned on successful completion of an EAP.
