The evidence did not meet just cause for Grievant's three (3)-day suspension for threatening a supervisor's life because the supervisor could not appear at the hearing and witnesses did not hear the entire conversation. The grievant threatened to kill his supervisor. However, the grievance wasì sustained on the basis that the supervisor did not testify due to his havingì moved outside the state. Since there was no opportunity to cross-examine andì since the arbitrator had no opportunity to evaluate his version of events,ì the grievance was sustained. The arbitrator also held that the testimony ofì one witness who heard the threat but not the whole conversation did not meetì the standard for just cause.
