MODIFIED. Though Grievant's removal for his third sleeping-on-the-job offense was justified, he was not given adequate notice of the termination. Removal modified to a ten (10)-day suspension. Grievant was terminated for sleeping on duty, his 3rd offense. Managementì maintained that termination was warranted because the grievant's position asì a Youth Leader in a maximum security facility required vigilance. Theì arbitrator found that sleeping on duty posed a danger to staff and inmates.ì However, the penalty was modified because the grievant was not given adequateì advance notice that he might be terminated. The discharge was reduced to 10ì days. Grievance was modified.
