Grievance DENIED. The Arbitrator determined that the issue was whether Management violated the contract by not paying employees swing or relief dispatcher shift differential and/or minimum court appearances compensation of 2.5 hours at the new contract rates retroactive to January 1, 1989. Relying on contract law principles, the arbitrator held that the language of the contract did not support the union's view, since only the bare wage rate was expressly covered by a retroactivity provision.
