Grievance DENIED. First, the arbitrator ruled that the scope of an arbitrator's authority may be modified in a previous grievance settlement agreement. The sole question in this case was whether the grievant committed the alleged act of sleeping on duty. If so, the arbitrator was powerless to modify the penalty. Despite the absence of corroboration, the Arbitrator found a photograph to be sufficient evidence that the Grievant was sleeping on duty. Even without the allegation of the late call-in, sleeping on duty is sufficient to deny the grievance.
