There was not just cause to remove the Grievant from her position. There was no credible proof the Grievant had an unauthorized relationship with Youth G, nor was credible proof the Grievant had unauthorized or inappropriate contact with Youth G/family. There was substantial evidence that the Grievant failed to provide a clear and accurate response during the investigatory interview. Given the Grievant’s long tenure and clean disciplinary record this violation only merits a five-day suspension. The Grievant is reinstated to her prior position with back pay (less the suspension), benefits, seniority, shift and post to be reinstated. The grievance was MODIFIED.
