HOLDING: Grievance DENIED. Employer met its burden and proved Grievant engaged in misconduct justifying removal. Two rule violations warranted removal in this case. First, an act or failure to act which constitutes a threat to the security of an individual under department supervision is a violation of rule 38. Rule 41 prohibits any unauthorized act or failure to act that could harm any individual under department supervision. Employer established just cause for Grievant’s removal based on totality of evidence.
