GRANTED. The termination was without just cause because there is insufficient proof the Grievant knew or should have known access to the records was a prohibited act within her overall rights as a Union delegate. The Grievant should have received clear notice from management about the limits of her Union duties corresponding to her access to inmate medical records.
Supplemental: Grievance MODIFIED. The Arbitrator reviewed adjusted his award to provide Grievant with lost wages from the date of her termination to the date of her retirement less offsets. Grievant was awarded hazard pay, lost overtime, applicable shift premium, health insurance replacement costs, uniform allowance, and leave accruals until the date of retirement. Employer was ordered to pay interest on the award in an amount of 5% per annum from date of termination.
