The Arbitrator found evidence presented at the hearing, in support of the charges were sufficient to show just cause exists to justify discipline; however, the same evidence was insufficient to make a determination that a demotion was the appropriate penalty. As a result, the demotion is overturned and a five day, 40 hour unpaid suspension is issued and the Grievant is returned to rank of Sergeant.
