The Grievant wanted to be treated as a voluntary physical fitness tester rather than a mandatory physical fitness tester because of his status with the Employer previous to his resignation and rehire. The Grievant gave up his voluntary tester status by virtue of his resignation in 2006, and is subject to the mandatory physical fitness testing because his most recent hire date, February 12, 2007 is after the January 1, 2004 date in Sections 31.05 of the contract.
