HOLDING: Grievance SUSTAINED IN PART AND DENIED IN PART. The Arbitrator found that there was just cause for discipline but that termination was disproportionate to the offense. The Grievant was reinstated to his prior assignment and his termination was converted to a 90 day suspension with all back pay, benefits and seniority restored for time-off beyond the 90 day suspension.
