Grievance MODIFIED. The Arbitrator found that the Employer had just cause to impose discipline for sexually harassing and intimidating another employee in two of three incidents for which he was charged. The Employer did not have just cause to impose discipline for insubordination, sexual harassment or intimidation for the December 4, 2003 incident, and the Arbitrator reduced the penalty from a 30-day suspension to a 20-day suspension.
