The Grievance is DENIED in part and GRANTED in part. DRC’s management employee did not follow proper protocol in denying the Grievant’s FMLA request and DRC did not have just cause to remove her for failure to provide a physician’s verification. The Grievant shall be reinstated within 14 days of award with no back pay or economic benefit but is entitled to service and/or institutional seniority rights.
