Grievance was MODIFIED. The Arbitrator agreed that there was just cause to remove the Grievant for soliciting a sexual favor in exchange for a passing test score. However, she found that the Employer violated Section 24.05 in that the decision to terminate the Grievant was made before, rather than after, the pre-disciplinary hearing. Therefore, she ordered that the termination would take effect on March 18, 2002, the date that the arbitration record was closed, and she awarded back pay and benefits from the previous termination date.
