Grievance MODIFIED. Grievant was removed for repeatedly making inappropriate comments to driver’s license examinees and co-workers. However, the arbitrator did not find just cause for removal because the Employer had not taken sufficient steps to deal with the grievant’s offensive behavior in the past. The arbitrator stated that the Grievant should have been sent to sexual harassment training after a previous discipline. The Arbitrator returned the Grievant to work with no back pay.
