Grievance was DENIED. The Arbitrator found that the Employer had just cause to remove the Grievant because she violated a Last Chance Agreement by making false statements about a coworker. The Arbitrator said that arbitrators strictly enforce Last Chance Agreements in accordance with the terms the parties accepted, regardless of how harsh or strict the terms are. In this particular Last Chance Agreement, the Grievant agreed to not make any false, abusive, inflammatory, or obscene statements, and termination was the only available remedy.
