Grievance modified. The Arbitrator found that Grievant was wrong to assume he could take the rest of the day off after a two hour examination and should have followed the “work now, grieve later” principle. Grievant had past discipline for absences and should have realized he would need supervisory approval for time off. However, the Arbitrator found that moving from a three-day suspension to a removal was “too big of a leap” for progressive discipline and modified the grievance to a time-served suspension.
