Grievance #15-00-20000320-0043-04-01 is denied. The Arbitrator found that a one-day suspension is appropriate for a first time failure to honor a subpoena because Grievant had a duty to appear regardless of the short notice, his other plans, or how little he felt he had to contribute to the case. Grievance #15-00-20000912-0127-04-01 is modified. The Arbitrator found nothing improper or particularly unusual about Grievant’s in court behavior. However, the Arbitrator found that Grievant should not have called the defendant a liar and reduced his five-day suspension to a one-day suspension.
