Grievance DENIED. The Arbitrator found that the parties had all entered into a binding last chance agreement which, if violated by the grievant, would prohibit any just cause consideration of the merits. Finding that the Commission’s return to work directive to the grievant was not ambiguous, and that she did not comply with that or with other directives to document the reasons for her absences, though given ample opportunity to do so, the Arbitrator had no choice but to deny the grievance since these acts were clear violations of the LCA.
