Grievance was DENIED. Classon Martini, a Theraputic Program Worker (TPW) at Columbus Developmental Center, was terminated from his employment for grabbing a co-worker by the neck and attempting to kiss her on the lips. The Employer argued that the termination was deserved under Article 24 of the contract because of other allegations by female co-workers involving inappropriate sexual behavior on the part of the Grievant. The Union argued that the Grievant was the victim of a conspiracy and that the investigative methods used by the Employer were incomplete and biased. The Arbitrator felt that the pattern of unwanted sexual advances on the part of the Grievant was sufficient to warrant his termination. For all the above reasons, the grievance was denied in its entirety.
