Grievance was GRANTED. Grievant, a Juvenile Corrections Officer at Maumee Youth Center, was terminated for being absent from work without authorized leave. The Employer argued that the Grievant, who had an extensive discipline history, took unauthorized emergency leave to attend his uncle-in-law’s funeral. The Employer argued that the Grievant took April 25 off using emergency vacation leave and that he had no claim to it. The Union argued that the Employer used the emergency vacation leave issue as a way to get rid of an employee they didn’t like. The Union argued that the Grievant had leave balances to cover his absence but was never given a chance to use them. The Arbitrator agreed with the Union’s assessment and felt that arguably, the Grievant’s absence met the definition used for emergency vacation leave. Therefore, the grievance was GRANTED.
