The Grievance was DENIED. Given the testimony concerning the Grievant’s race based remarks, the Arbitrator found that “a condescending pattern of racial categorizing becomes apparent.” The Arbitrator determined that given the substantial evidence of inappropriate conduct and the potential harm and conflict that the Grievant’s conduct could cause in the environment of a correctional institution, the Employer had just cause for discharge.
