Grievances were MODIFIED. The Arbitrator found that Management did not meet its burden of clear and convincing proof that the Grievants had committed any of the rule violations except for Poor Judgement in that they attempted to move an inmate who was obviously violently opposed to the move without consultation with higher management. The Arbitrator found that the Grievants’ actions were not purposeful and that they had no intent to harm the inmate. The Arbitrator modified the removals to ten day suspensions.
