Grievance was MODIFIED. Arbitrator Furman stated that the Grievant clearly behaved in an unacceptable manner. However, the Arbitrator found the Employer failed to prove the Grievant used profane language because no member of the public or any co-workers seemed to hear the exchanged between the Grievant and the Sergeant. The Arbitrator found the Grievant’s “nearly ten year unimpeached record . . . provide[d] the basis for a modification of the penalty. Arbitrator Furman reduced the suspension to a written reprimand.
