Grievance was MODIFIED. The arbitrator found that DR&C work rule 46a carries a range of discipline to include a suspension to removal for a first offense. Since the grievant had only a written reprimand in his record, that he had been “employee of the month”, and that his general deportment and work record had been at least satisfactory, the penalty of removal was not progressive nor commensurate. The removal was modified to a one year suspension.
