Grievance is DENIED. The Arbitrator held he did not have jurisdiction to decide this case. The Union had previously filed and withdrawn a grievance over the same issue. That grievance was withdrawn and the incident did not occur again. The Arbitrator held the Union’s grievance was untimely filed because the last time event occurred was in 1995. The contract provides that a grievance must be filed within fourteen (14) days of the event giving rise to the grievance.
