MODIFIED. Grievant was suspended for three days for violating the department’s sexual harassment policy. The Arbitrator found sufficient mitigating circumstances to mitigate the Grievant’s discipline: this was the first time he had been notified his behavior was offensive, his long discipline-free record of service, and the Grievant did not touch the offended employee nor did he use harsh or profane language. The Arbitrator held that the suspension would remain on the Grievant’s record, but that the Grievant could earn back one day’s pay after completing a sexual harassment training course and remaining discipline-free for one year.
