Arbitrator Pincus held that the employer violated Article 17 when it failed to promote the Grievants even though they met the minimum qualifications specified in a previously entered into Memorandum of Understanding (“MOU”). The Arbitrator ordered the employer to pay the Grievants for financial losses they incurred as a result of not being promoted according to the MOU.
