Grievance was DENIED. Grievant, operating under a Last Chance Agreement for on-duty inefficiency, was terminated for his off-duty presence at the Gallipolis Post of the Ohio Highway Patrol while intoxicated, and for improper use of the breath testing equipment while off-duty and intoxicated. The Arbitrator held the termination was proper because the improper use of the Employer’s equipment while off duty converted his actions into on-duty behavior.
