MODIFIED. Grievant was terminated for violation of two work rules: Conduct unbecoming an officer (conduct that may bring discredit to the division and/or any of its members or employees), and Making a false statement concerning his/her conduct or the conduct of others. These charges were brought after the Grievant had sex with a Trooper in his bedroom at the Patrol Academy and then lied about the incident during the investigation. The Arbitrator held that the Employer should have considered the Grievant’s eight years of exemplary service. He reinstated the Grievant with no back pay and without loss of seniority.
