Grievances were GRANTED. Arbitrator Graham pointed out that the word “shall” is mandatory and “does not confer upon the Employer discretion to grant or not to grant the leave, no matter how extensive the amount of leave may be.” Because the Grievants did not meet this definition of “party,” he found that the Employer could not deny the Grievant’s request for Witness Duty Leave. For these reasons, the Grievances were granted.
