MODIFIED. The Grievant was reinstated and transferred to North Central Correctional Institution (NCCI) as a Correctional Officer. She received no back pay, but retained her state seniority. Time off from her termination date to her return to work date was coded as “approved leave without pay.” The parties also agreed that the Grievant would serve a one-year Last Chance Agreement in which she agreed to commit no further violations of Rules 2B, 3B, and 3H. The Arbitrator retained jurisdiction over the case during the life of the Last Chance Agreement, and all parties agreed that the award would be non-precedent setting.
