Grievance was GRANTED. The Arbitrator found the Grievant was not guilty of physical abuse. She ordered the Grievant to be reinstated with full back pay and benefits, minus any interim earnings.This grievance was arbitrated a second time after the Union successfully challenged a prior arbitration award. The Union moved that the prior arbitration award be vacated on the grounds that the Arbitrator improperly considered the Grievant’s criminal “no contest” plea as evidence of his guilt at arbitration. The Union’s motion was granted and the case was remanded to arbitration. (See Award Number 1243).
