Grievance was SUSTAINED. The parties did not agree on the facts giving rise to the imposition of discipline by the Employer. The Employer argued that the Grievant became verbally abusive towards his supervisor, yelled at her and pointed his finger at her. The Union argued that discipline was imposed by the fiancé of the Grievant’s supervisor, thus making the imposition of discipline suspect. Two other employees who were present at the scene stated that nothing unusual occurred on the date in question. After discussing the “burden of proof,” the Arbitrator found that the Employer could not prove its case and sustained the grievance.
