Grievance DENIED. The Grievant was removed for failure to follow a direct order to take a prisoner on an emergency medical trip. The Grievant also failed to take the inmate to Post 5 when ordered to do so, but instead took the inmate to Security Control. The Grievant was also charged with refusing mandatory overtime. The Arbitrator felt that in the emergency situation that the Grievant should have "worked first, grieved later". The Grievant was given a legitimate order that he did not follow. Based upon the Grievant's prior record and the severity of the offense, the Arbitrator felt that the discipline was both commensurate and progressive.
