DENIED with stipulation. Grievant was removed from crash reconstruction unit without just cause in violation of Article 30.03. Employee was awarded position in error and thus removed as a result of a grievance filed. Arbitrator stipulates that if the position should be vacated for any reason, it shall be awarded to this grievant with these stipulations: May be denied for just cause including any suspenion. The position will not be posted or grievable and will also apply to any newly created sergeant position in the crash reconstruction unit. Agreement shall in no way be precedent setting and shall expire in 4 years from date of signing.
