GRANTED. The language of the Agreement stating that "all Attorney classifications" have their probationary periods increased from 180 days to one year did not apply to District Hearing Officers (DHOs). While the State may have wanted to include DHOs in the change, it failed to communicate it properly to the Union. Employer also violated Section 36.05 by not giving the Union 45 days advance notice of the change in the probationary period for DHOs.
