Award: 877 The Grievant was removed for failure of good behavior, making falseì statements toward another employee, failure to immediately report a violationì of any work rule, giving preferential treatment to an inmate, exchange ofì personal information with an inmate, committing a sexual act with an inmate. The Arbitrator felt that the Grievant was guilty of at least three of theì charges: (1) failure to immediately report a violation of any work rule; (2)ì giving preferential treatment to an inmate and; (3) exchanging personalì information with an inmate. The Arbitrator felt that it was difficult forì the Union to provide substantial evidence against these charges without theì Grievant present at the hearing. The Arbitrator also felt that regardless ofì the reasons for misconduct, it was enough that she deliberately chose toì follow a course of behavior which violated some of the Employer's mostì important work rules.
