GRANTED. Grievants were removed for physical abuse of inmates. There was an arbitrability issue regarding the timeliness of the State's investigation and discipline. But, the Arbitrator found it unnecessary to rule on the timeliness issue due to the resolution of the remaining issues. The Arbitrator found that the testimony of grievants, witnesses and all involved was contradictive and unclear. Although, the time lapse could have been partially responsible for the changing and contradictive statements, the Arbitrator found that they created an unclear and unbelievable account of the events. The Arbitrator held that the State did not establish that grievants committed abuse. The Arbitrator also held that the State did prove the allegation contained in the original discharge that grievant Peace sought to coerce witnesses.
